GROUNDS FOR DIVORCE: NO-FAULT or FAULT ?

No-Fault grounds for divorce:
(a) Irreconcilable differences which have caused the irremediable breakdown of the marriage; or
(b) Living separate and apart without cohabitation for 3 years.

General grounds for divorce:
(a) Impotence;
(b) Adultery;
(c) Abandonment and presumed dead;
(d) Alcoholism and/or drug addiction;
(e) Confinement for incurable insanity;
(f) Failure to consummate marriage;
(g) Willful desertion for 5 years (or less within the discretion of the court);
(h) Cruel and inhuman treatment;
(i) Bigamy;
(j) Life imprisonment;
(k) Spouse is of unsound mind;
(l) Incest; and
(m) Gross neglect.
